Measures to combat late payment in commercial transactions

FIELD APPLICATION: Commercial transactions between undertakings or between business and government, as well as transactions between main contractors and their suppliers and subcontractors.

 

PRIVATE SECTOR

 

The deadline for payment must meet the debtor is 60 days. Within 60 days will be from the date of receipt of goods or provision of services even in the case of receipt of the invoice before the goods or services or if there is provision of a verification procedure. The law provides that this period will be adjusted gradually according to the following timetable:

Will be 75 days after receipt

Providers must send the invoice or request for payment equal to their clients before they are 30 days from the date of actual receipt of goods or services.
 
May be grouped income over a specified period not exceeding 15 days by a comprehensive bill of all deliveries in this period.
 

 

 

PUBLIC SECTOR

 

The administration is obliged to pay the price within 30 days from the date of the issuance of certificates of construction or documents evidencing the completion of the contract.
 
This period of 30 days will apply from January 1, 2013
 
After the expiry of 30 days, the contractor may claim in writing to the Contracting Authority compliance with the obligation to pay and, if default interest. If the administration does not answer within 1 month recognized means of payment deadline and stakeholders may make an administrative appeal against the inaction of the administration, may apply as a precautionary measure the immediate payment of the debt.
 
Transitional periods for the implementation period of 30 days:

Will be within 55 days following the date of the certification work.
 
Will be within 50 days following the date of construction certificates
 
Shall be 40 days from the date of the certification work.
 

 
 
 

The civil works construction companies to keep alive the works contracts with different government, exceptionally, and for two years from the date of entry into force of this Act, may agree are its suppliers / subcontractors following payment deadlines, in accordance with the following schedule of implementation, without the covenants may exceed the time limits.
